Compensation for Horse Riding Accidents Caused by Hit and Run Drivers

We mentioned in our post about road traffic accidents involving horses, that we don't ordinarily associate the term RTA or Traffic Accident, with horses - and so it is with hit and run drivers - but you may be surprised by how frequently hit and run incidents involving horses occur.

Although it’s hard to find figures as many of these types of incidents are not reported to the police, there are enough highlighted in the media to know that it’s happening on a regular basis.

Just last month police in Renfrew were searching for a speeding van driver who smashed into a horse leaving it with “horrific injuries”. The rider was forced to throw herself from the horse as it bolted. The driver didn’t stop to check if the horse or rider were ok but drove away from the scene with a missing wing mirror. The horse was left needing 19 stitches.

In the New Forest, where ponies, cattle, pigs and donkeys roam free, hit and runs also unfortunately happen. Although thankfully the number of animal deaths caused byroad traffic accidents is decreasing, from 313 in 1962 to 181 in 1991 down massively to 72 in 2013, but the aim is get it lower still and they have put out a video with tips for driving safely in the area to help decrease horse injuries.

The Verderers of the New Forest, who are there to (amongst other things) help protect the animals, offer a £1000 reward for information leading to the successful prosecution of drivers convicted of a hit and run involving a New Forest animal.

Horse riding accident victims as a result of hit and run drivers are, of course, just as entitled to seek compensation for their horse riding injuries as those involved with collisions where the driver details are known. And even in cases where the personal responsible for the accident drives away or cannot be traced, it is still possible to claim compensation. The Motor Insurers' Bureau (MIB) was established in 1946 to compensate the victims of negligent uninsured and untraced motorists.

You can make a claim to the MIB under the untraced drivers' agreement for a hit and run driver accidents on their website. However as MIB claims can be subject to different rules and timescales than a standard personal injury compensation claim it may be useful to have expert advice to help you ensure you have best chance of making a successful claim.
