Did you know that statistically, each of us will be involved in at least one road traffic accident within our lifetime?
I myself have been in two and whilst I was lucky enough to walk away from both unscathed, there are an estimated 300,000 injuries each year caused by road traffic accidents. It’s no wonder that road traffic accidents (or RTA’s) make up the majority of personal injury claims.
Road traffic accidents are not limited to car collisions they also include pedestrians& cyclists being knocked down and injured, accidents involving motorbikes and injuries to passengers.
Pick up your local newspaper or go online and you are almost guaranteed to find a story relating to an RTA.
Of course, not all injuries sustained due to a collision with a motor vehicle constitute a claim, but if you were involved in a road traffic accident that wasn't your fault and it took place within the last 3 years, then you may be able to make a compensation claim.
Have You Been Involved in an RTA?
Below are just some examples of circumstances where you’d be able to make a personal injury claim.
Driver
It's common for a driver to be found at fault if they have committed one of the following acts;
- They have driven into the back of your car (this is called a rear-end accident)
- Their car is driving on the wrong side of the road
- They hit your vehicle while you are stationery.
Passenger
If you were a passenger in a vehicle and you were injured due to the actions of the person driving either the vehicle you were travelling in, or another vehicle, you could make a claim for compensation.
Pedestrian
If you were injured whilest using a pedestrian crossing, or hit by a speeding vehicle, you may be entitled to compensation.
Cyclist
Personal injury claims for cyclists often come about due to accidents involving another vehicle. But poor or badly repaired road surfaces (such as pot holes) and faulty equipment (bikes and/ or helmets) can also be reasons for a claim.
Motorcyclist
As with cyclists, Motor Bikes are also susceptible to poor or badly maintained road surfaces and being hit by other motorists.
Diesel/petrol spills are also an example of a situation where a motorcyclist could make a compensation claim. Motorcyclists are statistically the motorists most at risk from personal injuries as they are less visible to other motorists and have less protection if they crash.
Passenger on a form of public transport
When travelling on a bus, train, taxi, ferry, coach or any form of public transport the operators have a duty of care to you. Examples of cases for a compensation case include being injured in a road traffic accident due to driver neglect, being thrown from your seat or off your feet due to the driver braking or accelerating unnecessarily hard and injuries sustained when leaving or entering the vehicle.
What to do in the Event of An Accident
If you are involved in a road traffic accident then remember:
- If another driver was involved get their details; registration number, name, address and telephone number and insurance details.
- If there are witnesses, write down their contact details.
- Take a photo of the scene of the accident
- Report the accident to the police.
- Never apologise or admit liability whilst at the scene.
- Seek medical attention for your injuries, either by visiting your GP or the local A&E depending on their severity.
If you have been involved in a road traffic accident in the last 3 years that wasn’t your fault you may be entitled to be compensated for any financial losses and/or a bodily injury which may have occurred. Financial losses as a result of the road traffic accident may include: loss of earnings, travel expenses, payments for medicines and / or medical treatment and repairs to vehicles to name but a few.
